This page details terms related to Lepitsune adoptable ownership and usage of species-related artwork. Please review the website terms of service here.
"Admins" and "moderators" refer to Jay, Minsu, Cy, and Emi. Species information provided by any other user in any other capacity is not official. Please file a ticket on the site if you have additional concerns not covered by these terms.
1. Adoptable Ownership
- The Lepitsune species and all future related and derivative species created by Jay are closed species and may not be made without possessing a MYO ("make your own") slot.
- Lepitsune designs can only be used for personal purposes and commercial usage is strictly disallowed.
- When purchasing a Lepitsune design from Jay or any official guest designers, Lepitsunes retain partial rights to the design, which include but are not limited to: rights to the intellectual property of the design, rights to the character's species concept, and the right to distribute, reproduce, or use the image as a sample for sales/self promotion. Lepitsunes will never reuse a sold design unless it has been traded back to an admin.
- Lepitsune designs may be edited under the parameters of the species traits. Please see the artwork usage section for information on editing the original artwork.
- Lepitsune owners may re-purpose their designs into other characters provided they have the express permission of the individual designer. Please see the resale and transfer section for additional details.
- Co-ownership of Lepitsunes is not allowed and moderators will not arbitrate any disputes regarding unofficial co-ownership.
2. Sale and Transfer
- All payments for official Lepitsune designs must be in USD, to be paid via PayPal, and processed within 24 hours of being requested. If the product is not paid for within this period, an admin may put it back up for sale, with no deference to the original purchaser if they still wish to purchase it. Lepitsunes does not moderate the currency or payment avenue for future resale of designs.
- All Lepitsune characters may be transferred to other users unless indicated otherwise on the masterlist.
- Resale of a Lepitsune is capped at the original sale price of the design, which may be viewed on the masterlist. Lepitsunes do not accrue value based on commissioned art as this is something that is not tracked on the masterlist, so you may not add on the price of commissioned art to your Lepitsune when reselling it. Past transactions that took place before this rule was formalized will not be penalized.
- A single Lepitsune purchase must be treated as a single adoptable in terms of ownership transfer. You may not create multiple designs based on a Lepitsune design that you own with the intent of transferring them separately.
3. Artwork Usage
- When purchasing an official Lepitsune design, the designer retains partial rights to the artwork, which include but are not limited to: the right to distribute, reproduce, or use the image as a sample for sales/self promotion. The designer will not claim ownership over any characters featured in the artwork, and will never use this artwork in a commercial context.
- Lepitsune owners may repost the original artwork of their design wherever they would like, as long as clear and proper credit is given - a link back to the designers' Toyhou.se, Twitter, or other applicable webpage - and the designer's watermark or signature remains intact and unaltered.
- Direct edits to the original artwork are allowed on a per-designer basis. Lepitsunes by Jay may be drawn over, color-shifted, or have filters applied to them, but must be run by Jay before being re-posted anywhere publicly.
- Usage of Lepitsune artwork to promote hate speech or harmful ideology (including but not limited to: homophobia, transphobia, racism, ableism, pedophilia, etc.) is strictly not allowed and will result in an immediate ban from participation in the species.
- Lepitsune website artwork such as the banner, site icons, favicon, encyclopedia artwork, and any others are not permitted for re-use on other websites. The artwork may be displayed if it is part of informational or promotional material linking back to the website, but users may not claim it as their own or re-purpose it for personal means.
- Lepitsunes and all related artwork are strictly prohibited from being used in any matters related to or promoting AI scraping or cryptocurrency (such as NFTs). Discovery of any Lepitsune artwork being used in these avenues will result in an immediate ban.
4. Design Edits
- Official Lepitsune designs may be edited with limitations imposed on a per-designer basis. Currently, official designs by Jay, Emi, or Cy may have their colors and markings edited freely, but as MYO slots are planned to be available in the future, it is strongly encouraged by Jay to reserve massive changes for MYO designs and to keep official designs recognizable to respect the work of the original designer. Recognizability is subjective and not moderated, and thus a suggestion rather than a hard rule.
- Lepitsune traits may not be added without a token of corresponding rarity. Common and uncommon traits that a design already possesses may be swapped out for others within its rarity tier on a 1:1 basis, rare and above traits may be swapped out for traits in lower rarity tiers (e.g., you may not exchange a basic halo for basic horns, but you may exchange a basic halo for glowing markings).
5. MYO ("make your own") Slots
- MYO ("make your own") slots are officially sanctioned slots that may be redeemed for a single Lepitsune character, provided that the character fits within the trait and design allowances originally listed within the slot.
- Characters made with MYO slots are only usable in group activities, such as Secret Santa and art raffle events, after the slot has been redeemed and the character is on the official masterlist. Any verbal confirmation of a design being acceptable, even by an admin, does not count as the slot being redeemed.
- MYO designs may be uniquely commissioned by an artist, or a re-use of an existing design, so long as any closed species designs being re-used allow this in their terms of service. Owners must have permission by any third party creators to have their design displayed on the official masterlist, and third party creators must be made aware of the Lepitsune artwork usage and commercial rights terms.
- Admins may reject any MYO designs at any time. Typically a reason will be given for rejection of a design, but is not expressly required.
- MYO slots may be transferred under the same rules as official Lepitsune designs: they may be resold if they have a resale value, and traded or gifted to other users if permitted on their masterlist entry.
6. Bans and blacklisting
- Users may be blacklisted from purchasing further Lepitsune designs or banned from accessing the Lorekeeper website for violating clauses within any of the site or species terms of service.
- Most first-time offenses will result in a warning being communicated by an admin; depending on the severity of the offense an immediate ban may be warranted. Admins reserve the right to ban a user from participation in the species even if they have not violated any terms of service, this is typically only invoked if a user has a verifiable history of scamming or chargebacking in other communities.
- Immediately bannable offenses include but are not limited to: attempting to scam other users by selling or trading the same design multiple times, art theft (tracing other artists' works or directly lifting it from another site without permission), submitting Lepitsune artwork for AI- or cryptocurrency-related matters, making chargebacks on either official sales or re-sales, using the Lepitsune name or artwork to promote hate speech, or submitting hateful or sexually explicit artwork to the website.
- Warnable offenses include: cancellation or withdrawal from a sale or auction (typically only allowed once, unless there is an emergency this type of behavior is not tolerated)
- Lepitsunes will not arbitrate disputes between users regarding character similarities in MYO designs. If an issue is found with an official Lepitsune design, users are encouraged to submit a ticket to the website.
7. Revocation and Voiding of Characters
- Lepitsunes will not revoke characters, even of banned or blacklisted users, unless the design was obtained through a scam or the character is involved in criminal behaviors such as pedophilia and zoophilia. Banned and blacklisted users may keep any characters that were lawfully obtained, but may not acquire more Lepitsune characters through sales or trades.
- Banned and blacklisted users may continue to use their characters on a personal basis but the characters cannot participate in nor will be be officially recognized in any site-run activities such as art raffles and exchanges.
- If a user is found knowingly attempting to obtain more characters for a banned or blacklisted user, that is grounds for their immediate ban as well.
- On a case-by-case basis, if a character is found to be the subject of a scam, Lepitsunes staff may re-claim the character for re-distribution depending on the nature of the scam. Lepitsunes staff are unable to reverse transactions that require a PayPal dispute to resolve but characters may be re-sold or have their officially recognized ownership changed provided a resolution cannot be made on a third party payment site.
- Voiding a character refers to its removal from the masterlist and its recognition in any official capacity, typically done if a user wishes to completely withdraw from the species. Lepitsunes created by Jay or other official designers cannot be voided, and voiding can only apply to MYO Lepitsunes that are designed by the current owner. Voided Lepitsunes will have their image replaced with a stock image on the masterlist and have trading disabled. If you did not design a Lepitsune but wish to void it, admins may disable trading on the design or revert it to a previous iteration of the design (if edited) instead. Please file a ticket to inquire about specific situations and staff will address them on a case-by-case basis.
